Hyderabad News. Buyers Win first Round as City Court Orders Maytas to Pay 95L to a customer who went to court

(Excl Ventures News) With no government help in sight, several customers of Maytas Hill County have filed cases against Maytas Properties seeking refund of the money they had deposited with the firm for their still incomplete or, in some cases , non-existent flats. In one such case that came up for hearing last Thursday, the third additional chief judge passed an interim order directing Maytas Properties to deposit Rs 95 lakh as security towards the petitioner.
So far, seven cases have been filed at the third additional chief judge city civil court. Customers of the Hill County project have in their petitions also sought cancellation of the sale deeds. They have stated that in the case of semi-finished apartments, more than 65 to 70 per cent money was taken by the Maytas Properties and money deposited by customers has been diverted.

The petitioner who secured a favourable order last week, G Parthasarathy, had filed a case on behalf of his son-in-law who had purchased a property in Maytas Hill County. The case was filed under the provisions of Arbitration and Conciliation Act. In his petition, he said that the amount of Rs 95 lakh was deposited with Maytas Properties at the time of flats purchase and the company had not only delayed delivery but also stated that it was unlikely that the company would be able to deliver at all.
Customers have also filed complaints with Greater Hyderabad Municipal Corporation stating that the money collected by Maytas Properties for the Hill County project should have been deposited in a separate bank account and used in a phased manner for the construction of the project, as per municipal rules. However, the company has not maintained a separate account for the project and diverted the money. Flat purchasers said they were awaiting action by the GHMC.
Customers of Maytas Hill County said that despite assurances from the government, and more recently from Salman Khurshid, there was no hope in sight for them. Earlier , Maytas Properties was sending them mailers on the projects progress, if any, but there has been no update in the recent past. We have no choice but to take the legal route to get our money back, said a customer .

The Example set by Sri Parthasarathy Garu, Father in Law of a buyer has to be lauded. People who have not followed him by not going to court may suffer at the end if Maytas is forced to shell out hard cash to few buyers, there will be nothing left for construction.
