A two-judge bench of the High Court presided over by Chief Justice N i s s a r Ahmed Kakru on Tuesday rejected a writ plea of the state government seeking to recover about 80 acres of land in Survey nos 36 and 37 of Goppanapalli village near Gacchibowli on the grounds that it was wrongly classified as patta land.
The bench of the chief justice and Justice P V Sanjay Kumar refused to set aside an order of a single judge who declared the said action of the government as illegal.The government had sought to reclassify the land in question as grazing land and not patta land and thereby affect the rights of the occupants who have been in possession of the same since 1950.
The power of the government to alter the land description after half a century was challenged by the land occupants and owners successfully.In the appeal,the government contended that its power to classify the land or correct the same cannot be inhibited by the afflux of time was rejected by the bench.
