The states consumer disputes redressal commission recently ordered Maytas Hill County to refund two customers the full amount they paid for booking flats at Bachupally in Ranga Reddy district.
G Harshavardhan of Madhuranagar in the city who had booked a flat with Maytas Hill County,Pvt Ltd.on February 17,2007 paid the full amount of Rs 77 lakh on the condition that he will get possession of the flat by March 2009.
According to the petitioner,Maytas Hill County cheated him by not delivering the possession of flat on the promised date. Harshavardhan said that he had availed a State Bank of India loan for buying the flat and the bank has already started recovering the monthly instalment from him.Maytas Hill County told the commission its inability to give possession of the flat by citing the unforeseen circumstances clause.
The company pleaded its helplessness to deliver the flat and said the clauses of agreement cannot be invoked under the special circumstances.
Holding that the company has violated the clauses of the agreement it entered into with the customer,the commission termed it as a deficiency in service and ordered repayment of the full amount with 9 per cent annual interest for a period of two years.
In another case, G Chandrasekhar of Habsiguda paid Rs 67 lakh for a flat in Hill Countys 12th floor by entering into an agreement with the company in November 2006. The company promised him that his flat would be ready to occupy by the end of 2008. But the flat was not even constructed, the petitioner told the commission. In this case also,the consumer forum ordered Maytas Hill County to repay the entire amount within four weeks.
Comment : Its nice to see several orders coming one after the other asking Hill County to Refund in full. The question is what will happen if they fail to refund? Obviously company has no money. The affected parties should start civil/criminal proceedings to make Maytas Property owners to degorge diverted cash by liquidating all their land and other investments. Till then Banks should be ordered not to charge EMI.
